Welcome to Snowdrops (snowdrops.me). These Terms & Conditions set out the basis on which we sell and supply products to you through our website. By placing an order with us, you confirm that you accept these terms, so please take a moment to read them carefully. We sell a range of snowdrops (Galanthus), other plants, greetings cards, fridge magnets and gardening tools, shipped within Scotland, England and Wales (we are currently unable to deliver to Northern Ireland). If you have any questions before you buy, you are welcome to get in touch with us using the contact details at the end of this page.
When you place an order, you are making an offer to buy the products in your basket. We will send you an order confirmation email acknowledging that we have received your order, but a binding contract is formed only once we confirm dispatch of your items. We reserve the right to decline or cancel an order, for example where a product is out of stock, where there has been a pricing or description error, or where we are unable to verify your payment.
All prices are shown in pounds sterling (GBP, £) and include VAT where applicable. We work hard to ensure that all prices and product details on our website are accurate. However, errors can occasionally occur. If we discover an error in the price of products you have ordered, we will contact you as soon as possible to let you know and to ask whether you wish to continue with the order at the correct price or cancel it. If we are unable to reach you, we will treat the order as cancelled and provide a full refund.
We accept payment securely through PayPal. You can pay using your PayPal balance or a debit or credit card via PayPal; your payment details are handled directly by PayPal and are not stored on our own systems. Payment is taken at the time your order is processed.
Cash on pickup is available for customers collecting snowdrops in person from Bruckhills Croft.
We ship to addresses in Scotland, England and Wales. We are currently unable to deliver to Northern Ireland. Standard delivery charges are shown at checkout before you confirm your order.
We aim to dispatch in-stock orders within 1 to 2 working days, with delivery typically following within a further 2 to 5 working days, depending on your location and the courier used. Estimated delivery times are provided in good faith but are not guaranteed, as some factors are outside our control. If your order has not arrived within a reasonable time, please contact us and we will help track it down.
Risk in the products passes to you on delivery. Please check your parcel on arrival and let us know promptly if anything is missing or appears damaged.
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you are a consumer you have the right to cancel most online orders within 14 days of receiving your goods, without giving any reason. This 14-day period starts the day after the day you (or someone you nominate) receive the goods. Where an order is delivered in multiple parts, the period runs from the day you receive the last item.
To exercise your right to cancel, simply let us know within the 14-day period by emailing us at the address below, clearly stating your order number and the items you wish to return. After telling us you wish to cancel, you then have a further 14 days to send the goods back to us. We recommend obtaining proof of postage, as you are responsible for the goods until they reach us.
We will refund the full price you paid for the returned goods, including the standard delivery cost of sending the items to you (note that if you chose a more expensive delivery option, we only refund the cost of our standard delivery). Refunds are issued to your original payment method. Where you paid by card via Stripe, the refund will be returned to that card; where you paid by cash on delivery, we will arrange a refund by an agreed method. We will process your refund without undue delay and within 14 days of receiving the goods back, or within 14 days of you providing proof that you have sent them, whichever is sooner.
Unless the goods are faulty, not as described, or we have agreed otherwise, you are responsible for the cost of returning items to us. We may reduce your refund to reflect any loss in value of the goods caused by handling beyond what is necessary to establish their nature, characteristics and functioning.
Certain items are excluded from the standard 14-day cancellation right, including: products that have been sealed for health or hygiene reasons (such as cosmetics, beauty items, earrings or intimate items) once the seal has been broken; goods that have been personalised or made to your specification; sealed audio, video or software products once unsealed; and perishable goods. These exclusions do not affect your separate legal rights if an item is faulty or not as described.
Your statutory rights under the Consumer Rights Act 2015 remain unaffected by this returns policy. If an item is faulty, you may be entitled to a repair, replacement or refund.
If you wish to cancel an order before it has been dispatched, please contact us as soon as possible and we will do our best to stop it. If the order has already been processed and dispatched, you can still return it under your 14-day cancellation right described above. We may cancel an order ourselves where a product is unavailable, where there has been an error in pricing or description, or where we are unable to take payment; in these cases we will notify you and refund any amount already paid.
We take care to describe and show our products accurately. Photographs, colours and packaging are for illustration only, and the actual product you receive may vary slightly, for example due to screen settings or minor changes by manufacturers. Weights, dimensions and capacities are approximate. All products are subject to availability, and we may change or discontinue items at any time. If a product you have ordered becomes unavailable, we will contact you and offer a suitable alternative or a full refund.
We will always meet our legal obligations to you as a consumer. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law, including your rights under the Consumer Rights Act 2015.
Subject to the above, we are not liable for losses that were not foreseeable, that were not caused by any breach on our part, or for business losses, as our products are supplied for domestic and private use only.
These Terms & Conditions and any dispute or claim arising out of them are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
